These Terms and Conditions of Sale (“T&Cs”) govern all product sales made through the website www.pensato.com
They apply to all purchases made by consumers within the European Union.
In accordance with applicable law, these sales are governed by French law, regardless of the country of dispatch.
Article 1 – Purpose
These terms apply to all sales of products made by PENSATO SARL.
The products include, but are not limited to, olive oils, condiments, gourmet food items, and related goods produced or selected by PENSATO SARL.
Shipments are made from Monaco or Italy to all EU countries without restriction, in accordance with e-commerce and European consumer protection laws.
Article 2 – Prices
Prices are indicated in euros, all taxes included (VAT and other applicable taxes on the day of order), unless stated otherwise, and exclude handling and shipping fees.
If you order from outside mainland France, you act as the importer of the product(s).
Custom duties or local taxes may apply to deliveries outside the EU (e.g. Switzerland, United Kingdom, USA).
These charges are not the responsibility of PENSATO SARL and remain at your expense.
All orders, regardless of their origin, must be paid in euros.
PENSATO SARL reserves the right to modify prices at any time, but the products will be invoiced based on the rate in effect at the time of order confirmation and subject to availability.
Products remain the property of PENSATO SARL until full payment has been received.
Once you physically take possession of the ordered products, the risk of loss or damage transfers to you.
Article 3 – Orders

Contractual information is provided in French and confirmed no later than upon order validation.
PENSATO SARL reserves the right to decline payment or cancel an order for any legitimate reason, including supply issues or anomalies related to the received order.
Article 4 – Order Confirmation
Any order placed on www.pensato.com implies full acceptance of these Terms and Conditions.
Confirmation of the order constitutes complete and unconditional agreement.
All submitted data and the recorded confirmation serve as proof of the transaction.
The order confirmation equals an electronic signature and acceptance of the operations carried out.
A summary of your order and a copy of these Terms will be sent to you by email upon confirmation.
Article 5 – Payment
Order validation implies an obligation to pay the total indicated price.

Bank details are provided at checkout. Orders are shipped only after receipt of funds in the PENSATO SARL account.
If payment is not received within 10 business days, PENSATO reserves the right to cancel the order.
Stock is not held while awaiting transfer payment — if a product becomes unavailable, it will be replaced by an equivalent or refunded in full.
Article 6 – Right of Withdrawal
In accordance with Articles L.221-18 and following of the French Consumer Code, you have 14 days from receipt of your order to exercise your right of withdrawal, without giving a reason or incurring penalties.
Returns must be in original condition and complete (packaging, accessories, instructions).
Food products, including olive oils and other sealed items, may only be returned if unopened and intact.
Under Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to perishable goods or to products unsealed after delivery.
Return shipping is free of charge and will be refunded upon request using the same payment method as your original purchase.
Refunds are issued within 14 days of receiving the returned products.
Article 7 – Availability
Products are offered while visible on the website and within available stock.
For non-stocked items, availability depends on our suppliers.
In case of unavailability after placing your order, you will be notified by email and the order will be automatically cancelled without charge.
The website www.pensato.com does not intend to sell in bulk.
PENSATO SARL reserves the right to decline any order exceeding 100 identical units.
Article 8 – Delivery
Products are delivered to the address specified during checkout.
Shipments are made from Monaco or Italy to all EU countries via FedEx, Colissimo, or DHL, depending on destination.
Average delivery time: 3 to 7 business days from dispatch (maximum 10 days).
You will receive an email notification when your order leaves our warehouse.
In case of shipping delays beyond this period, you may cancel your order under Article L.216-2 of the French Consumer Code.
If you subsequently receive the order, it will be refunded along with shipping fees.
Seller’s responsibility:
Products travel at the seller’s risk until actual receipt by the customer.
In the event of damage, breakage, missing item, or delivery error, the customer must notify contact@pensato.com within 48 hours, including photos.
After verification, PENSATO will replace or refund the item at no additional cost.
Note:
Incorrect addresses, absence at delivery, or unjustified refusals may cause extra charges borne by the customer.
Cases of force majeure (strikes, transport disruptions, extreme weather) cannot be attributed to PENSATO SARL.
Article 9 – Warranty
All our products benefit from the legal guarantee of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the Civil Code).
In case of non-conformity, the product may be returned, exchanged, or refunded.
Claims must be sent by email to contact@pensato.com within 30 days of receipt.
Products must be returned in their original condition with all components (packaging, accessories, documentation).
Shipping and return costs are reimbursed upon presentation of proof.
This article does not affect the right of withdrawal outlined in Article 6.
Article 10 – Liability and Product Quality
All products comply with current French regulations.
PENSATO SARL shall not be held liable for non-compliance with regulations of the destination country; customers are responsible for verifying local import and usage conditions.
Natural products:
PENSATO olive oils and gourmet foods are natural and crafted using traditional methods.
Slight variations in flavor, color, or texture may occur depending on harvests and seasons. These natural differences do not affect quality and cannot justify a complaint.
Storage:
To maintain quality, products should be stored away from heat, direct light, and humidity.
Any deterioration due to improper storage cannot be attributed to PENSATO SARL.
PENSATO SARL also declines responsibility for misuse of products or issues linked to internet use (service interruption, intrusion, virus, etc.).
Article 11 – Governing Law and Dispute Resolution
The sales contract is governed by Monaco law.
In case of dispute concerning interpretation, validity, or execution of the contract, customers are invited to contact PENSATO SARL to seek an amicable solution.
Failing agreement, disputes shall be submitted to the competent courts according to consumer law — either the courts of the consumer’s residence or the jurisdiction of Monte Carlo (Monaco).
Article 12 – Intellectual Property
All elements of the website www.pensato.com are the exclusive intellectual property of PENSATO SARL.
No one is authorized to reproduce, exploit, or distribute any part of the site, whether text, images, or sound, without prior written consent.
Any simple or hypertext link is strictly prohibited without prior written authorization from PENSATO SARL.
Article 13 – Personal Data
PENSATO SARL collects and processes customers’ personal data in compliance with the EU General Data Protection Regulation (GDPR – EU 2016/679) and the French Data Protection Act of January 6, 1978 (as amended).
Data is used for order management, delivery, payment processing, and communication.
It may also be used for:
• Customer relationship management (orders, invoices, after-sales service)
• Loyalty program management
• Satisfaction surveys
• Marketing communications and personalized offers
• Debt collection and legal compliance
• Internal analytics and statistics
Data may be shared with third-party service providers (carriers, payment processors, etc.) only as necessary for order fulfillment.

Article 14 – Archiving and Evidence
PENSATO SARL will archive order forms and invoices on a reliable and durable medium constituting a true copy, in accordance with Article 1348 of the French Civil Code.
Digital records maintained by PENSATO SARL will be considered valid proof of communications, orders, payments, and transactions between parties.
Article 15 – Extended Producer Responsibility (EPR) – Packaging
In compliance with Extended Producer Responsibility (EPR) regulations, PENSATO SARL fulfills all obligations relating to packaging placed on the market.
Final Clause – Quality and Commitment
PENSATO products are crafted with artisanal expertise, care, and selection for quality.
Minor variations in taste, color, or aroma may occur between harvests — a reflection of their natural origin, not a defect.
